Challenges of a traditional regulatory structure in the face of technological innovation in online gaming in Mexico

This article analyzes Mexican legislation concerning the online gambling industry,
considering the current social and technological changes. It employs a methodological approach that combines exegetical research and hermeneutic-interpretative analysis.
The exegetical research evaluates whether current legislation addresses online
gambling and its taxation, while the hermeneutic analysis examines the regulatory frameworks of Spain, the United States, and Mexico, using Atlas.ti software. The findings reveal that online gambling in Mexico lacks both legal and fiscal regulation.
Furthermore, a traditional regulatory structure, outpaced by technological advances, was identified, preventing accurate tax collection estimates, and hindering the
industry’s potential to generate employment and promote economic growth.
