Abstract

In the current context of Mexico, the treatment of human rights has taken a direction that invites reflection and offers innovative opportunities for their respect and promotion. Legislation and judicial practice have shown an increase in implicit and explicit restrictions on these fundamental rights, which raises serious concerns about the state of democracy and respect for human rights in the country. This article aims to analyze these limitations and their connection with the weighing of rights, using doctrinal and jurisdictional criteria as a frame of reference. The question to be asked fundamentally is how and why these restrictions on human rights are being imposed in Mexico and what effects they have on society. Through a detailed analysis, both the implicit limits, those that arise from the interpretation and application of the laws, and the explicit limits, clearly defined in the legislation, are explored. In addition, recent practical cases are presented that illustrate emerging trends in the limitation of human rights, providing concrete examples for a better understanding of the problem. The justification for this study lies in the need to identify and criticize those practices that have the potential to undermine human rights and to encourage more effective legal and political strategies to counteract them. By understanding these trends and their implications, we seek to promote greater protection and respect for human rights in all possible circumstances. Thus, this document not only contributes to the academic debate on the limitation of human rights in Mexico, but also offers valuable tools for the implementation of measures that ensure respect and promotion of these fundamental rights. The goal is to provide a deep and critical understanding of the limitations on human rights in Mexico and generate debate about how to best protect these rights in the future.
