A political-criminal vision of the criminal law of the enemy

Abstract

Enemy criminal law is a doctrinal thought that supports the most forceful criminal law today; this is about a radical normativity functionalism that aims to make some strokes to reach a punitive function more connected with reality, that is, more forceful. The main characteristic is the prospective that is applied in the types due to the dangerousness of certain entities; therefore, in this perspective it is important to point out the real enemy to whom rights will be relativized.
